RULES AND REGULATIONS

The following Rules and Regulations form an agreement between the International Lottery in Liechtenstein Foundation and you, the Player. Please read them carefully. You do not have to sign this agreement, but by entering a Draw, you acknowledge your understanding of these Rules and Regulations and your agreement to be bound by such Rules and Regulations in playing the Lottery Games offered by the International Lottery in Liechtenstein Foundation.
  1. In these Rules and Regulations:

    • “Affiliate” means a Player who refers another Player to the Foundation's website;

    • “Charities” means the beneficiaries of any money paid by the Foundation to a not-for-profit organization having a charitable purpose, as determined by the Charity Allocation Committee of the Foundation, in its sole discretion;

    • “Commission” means any money allocated or paid to an Affiliate in consideration for the sale of Valid Tickets bought by a Referee associated with that Affiliate;

    • “Deposit Account” means the account described in paragraph 2b;

    • “Dormant Account” means account which shows no activity for a period of twelve (12) consecutive months;

    • “Draw” means the random selection of winning combinations for any particular Lottery;

    • “Foundation” means the International Lottery in Liechtenstein Foundation, which is supervised by the Liechtenstein Government;

    • “Ineligible Persons” means persons described in paragraph 3c;

    • “KYC” refers to a Know Your Customer procedure, which must be completed when a Player's withdrawals total an amount equal to or greater than EUR 500 and/or he/she has used one or more credit cards on his/her Deposit Account;

    • “Lottery” or “Lotteries” means one or more lottery game(s) operated and managed by the Foundation;

    • “Marketing Fee” means the fee charged to the Player by partners of ILLF for the marketing and promotion of the games;

    • “Number” means one or more digits, one or more letters, one or more markings or any combination thereof;

    • “Parties” means the Foundation and the Player, as applicable;

    • “Person” includes an individual, corporation or a foundation;

    • “Player” means a person who registers his/her details on the Foundation's computer system database;

    • “Prize” means a money prize, or other property or benefit to which the holder of a Winning Ticket is entitled;

    • “Prize Pool” means, in respect of any particular Draw, the amount of money available for payment of Prizes;

    • “Purchase Price” means the amount paid by a Player for entry into a game, inclusive of a marketing fee;

    • “Referee” means a Player referred to the Foundation's website by an Affiliate;

    • “Sale” means the purchase of a Valid Ticket by a Player;

    • “Selection” means a Number or Numbers chosen by a Player, or by the computer on behalf of such Player, entitling the Player to participate in the Draw;

    • “Stake” for a single Player means the payment made for a Ticket by a Player and “Stakes” means the payments made by all Players in respect of a particular Draw (both Stake and Stakes exclude any marketing fees or license fees paid by the Player);

    • “Ticket” means a ticket, certificate, or other instrument issued by the Foundation as a record of a Player's purchase of the right to participate in a Lottery and recording a Player's Selection for such Lottery;

    • “Ticket Price” means the cost of a ticket for entry into a game, exclusive of a marketing fee;

    • “Valid Ticket” means a Ticket that is not void;

    • “Winner” means a Player who holds a Winning Ticket;

    • “Winning Ticket” means a Valid Ticket that bears one or more Numbers, or one or more Selections entitling its holder to a Prize according to the conditions for a Lottery established by the Foundation;

    • “Winnings Account” means the account described in paragraph 2g; and

    • “ILLF Account” means the Foundation's account referred to in paragraph 2h, which account bears the record and account of transactions incorporating all funds waiting clearance, Deposit Accounts and Winning Accounts, which are maintained for each Player.
  1. The Foundation operates a variety of different Lotteries. Some Lotteries are marketed through the Foundation's website directly, and other Lotteries are marketed through other websites owned by third parties authorized to market Tickets on behalf of the Foundation. These rules apply to all Lotteries operated by the Foundation, irrespective of how such Lotteries may be marketed. The specific rules for each Lottery operated by the Foundation are as set out in separate schedules hereto.

  2. Prior to participating in a Lottery, each Player will deposit funds into an account called a “Deposit Account”. The Deposit Account will hold the funds committed by the Player to participate in a Lottery. Ticket purchases made by the Player will be funded from the Deposit Account and in the event there are not sufficient funds in the Deposit Account to make a ticket purchase(s) and the Player has funds in his/her Winnings Account to cover the shortfall in the Deposit Account, the shortfall of funds will be taken from the Winnings Account. A Player may not withdraw funds from the Deposit Account and all funds in the Deposit Account must be used to participate in a Draw.

  3. When a Player purchases a Ticket, in some instances, the Player will be obligated to pay both the ticket price for the Ticket plus a marketing fee payable to or for the benefit of one or more third party marketing companies (the “Fee”) engaged by the Foundation. For each Lottery game, the allocation of the amount to be paid by the Player on account of the Ticket and the Fee will be identified in the Rules for each such Lottery game. Notwithstanding the allocation of proceeds between the Ticket and the Fee, all amounts shall be paid by the Player to the Foundation and will be allocated by the Foundation between the Ticket price and the Fee, as required by the Rules of each Lottery game. When a Player purchases a Ticket the full Purchase Price is withdrawn from the Player's Deposit Account immediately upon their purchase of the Ticket.

  4. Upon payment of the required funds for the establishment of the Deposit Account and submission to the Foundation of satisfactory evidence of the Player's residence, the Foundation will accept and record in its computer system Ticket Sales received by a Player through the internet, or by any other mode of subscription approved by the Foundation. Upon issuance to a Player of a Ticket, the Player will be deemed to hold a Ticket bearing the information noted on each Ticket so ordered with the corresponding Selection concurrently recorded in the Foundation computer system. If the purchased Ticket is a Winning Ticket, the Player who is recorded in the Foundation computer system as the purchaser of the Winning Ticket will be deemed to have produced to the Foundation a written claim for the Prize and to have delivered the Winning Ticket to the Foundation and will be identified in the Foundation computer system as holding a Winning Ticket, all to be determined within 24 hours following the applicable Draw.

  5. The Foundation may, at any time at its discretion, refuse to issue a Ticket bearing any Selection or limit the number of Selections that may be made by, or the number of Tickets that may be sold, to any Player, in its sole and absolute discretion.

  6. The legal arrangement between the Foundation and Players as contemplated in these Rules and Regulations shall not be deemed to be created and a Ticket shall not be deemed to be purchased by a Player until the information required by the Foundation is received by the Foundation and recorded in its records in Liechtenstein and either (i) any credit card authorizations for payment of the Ticket Price and the Fee, as applicable, are approved in favour of the Foundation or (ii) a deduction from the Player's Winnings Account or Deposit Account are withdrawn, sufficient to pay the price for a Ticket and to pay any Fee, as applicable.

  7. The Foundation will deposit any Prize won by a Player in the applicable Player's Winnings Account. Funds in the Player's Winnings Account can be withdrawn by the Player, or used by the Player to purchase additional Tickets (and applicable Fees). Prizes over EUR 10,000 are subject to a 30 day hold. Prior to paying out any Prize to a Player's Winning Account, the Foundation reserves the right to require Winners to show evidence to the Foundation that they were eligible to participate in the Lottery at the time of the Draw (see Ineligible Persons) and that they were authorized to use the credit card used by the Player to pay for the Winning Ticket.

  8. All funds on deposit with the Foundation, including the Deposit Account and the Winnings Account will be held in the ILLF Account with the Liechtensteinische Landesbank AG (LLB).

  9. The Foundation will not pay a Prize(s) to which a Player might otherwise be entitled if the Player's payment into the Deposit Account in respect of a Winning Ticket is dishonored in any way or for any reason. The Foundation further reserves the right to cancel all outstanding entries for such Players and to prevent such Players from playing any of the Lotteries in the future.

  10. In the event of a discrepancy between the Numbers that the Player claims they have entered, or the graphic display of the game that they have played, or the email or written confirmation that the Player has received, and those in the database maintained by the Foundation, the Numbers in the Foundation database will be deemed to conclusively reflect the applicable Player Numbers. Players are responsible for checking details of any Ticket by contacting the Foundation's customer support or by selecting the 'My Future Tickets' or 'My Previous Tickets' screen for the relevant Draw from the Foundation's website associated with the particular Lottery.

  11. The Foundation will not be liable to the Player for any delay in the making of a Draw. A Draw in the Lottery may be made by any method established by the Foundation and may be held at any time and place as the Foundation determines, in its sole and unfettered discretion. If a Draw cannot be held on a scheduled date, such Draw shall be held as soon as practicable thereafter as determined by the Foundation.

  12. A Player may not cancel a Ticket purchased by a Player and the Foundation is not required to provide refunds to Players, even if the Draw has not yet occurred at the time of request for a refund by the Player. The status of the Player's entry may be confirmed by selecting the 'My Future Tickets' screen for the relevant Draw from the Foundation's website for the applicable Lottery. The last entry for the Euro World Lotto Draw must be registered in the Foundation's database in Liechtenstein by 14:55 Central European Time ('CET') on the day of the Draw. The last entry for the Equinox and Little Big One Draws must be registered in the Foundation's database in Liechtenstein by 11:00 Central European Time ('CET') on the day of the Draws. Entries received by Players after these times will be entered for the next Draw.

  13. Notwithstanding anything else herein, the Foundation has no obligation to pay or deliver a Prize, unless the Player holding the Winning Ticket, if requested by the Foundation, gives satisfactory evidence of identification and/or valid release for the Prize, and undertakes to indemnify and save the Foundation harmless from any further claims made by such holder or by any other Person in respect of such Prize.

  14. The Foundation has the right to suspend or withdraw any Draw in its absolute discretion, including without limitation, a Draw that has less than a specified number of Players. Any entry for a Ticket that contains fewer than the required minimum Numbers, as determined by the Foundation, will be deemed to be invalid. In cases of an invalid draw, withdrawn draw or a suspended draw, the Foundation will refund to the Player the cost of the Ticket or Tickets, and any Fee associated with such Ticket(s) and the Player will have no further claim or remedy against the Foundation.

  15. The Foundation reserves the right to contact any Player, including Referees, by email, post or telephone with information relating to or marketing the Lotteries. The Foundation further reserves the right to contract this process to an authorized party marketing Tickets on behalf of the Foundation.

  1. Any Ticket:
    • for which payment has not been received prior to the date on which it would have, but for such non-payment, becomes a Winning Ticket;

    • for which the computer entries have not been recorded;

    • purchased by an Ineligible Person;

    • held or purchased by Persons under 18 years of age; or

    • that has been lost as a result of a computer failure or otherwise,

    is void, and shall not in any case entitle its holder to a Prize.

    A Player holding a void Ticket is not entitled to a refund from the Foundation.

  2. Persons under 18 years of age may not open a Deposit Account or Winnings Account or participate in any Lottery. Players who win Prizes will be required to show that they were over the age of 18 at the time the Ticket was purchased.

  3. The Foundation is unable to accept purchases from and the following persons are ineligible to participate in any Lottery:
    • persons buying Tickets through Swiss servers;

    • employees, servants, agents, and family of the Foundation, or its affiliates; or

    • representatives, partners, and staff of Thöny Treuhand AG or Arthur J. Gallagher (UK) Limited, a Lloyd's broker.

      (“Ineligible Persons”)

    For the purposes of this paragraph, Family means any child, spouse or common-law partner of a Person referred to above.

  4. Additional rules for each Lottery approved by the Foundation are set out in separate schedules to this Agreement.
  1. The Foundation will make reasonable efforts to contact Winners by e-mail; however Winners will be responsible for checking with the Foundation to determine whether they hold a Winning Ticket or have any funds deposited to their Winnings Account. In the event of any dispute between a Player and the Foundation in regards to a Prize, the Foundation may, in the case of a money Prize, pay such disputed funds into court, or as directed by the court, and in the case of any other Prize, deliver the Prize, or evidence of entitlement thereto, to the court, pending determination of the matter by a court of competent jurisdiction.

  2. In the event more than one Player holds Tickets matching the required winning Numbers, the Prize will be shared equally among Players holding Winning Tickets. The Foundation may operate more than one Lottery all having identical Rules but which games are branded and marketed by the Foundation as different Lottery games. In such event, if one or more Players hold Tickets matching the required winning Numbers each from different branded Lottery games, the Prize will be shared equally among Players holding Winning Tickets from all of the different branded Lottery games.

  3. A Person who makes a claim for a Prize is conclusively deemed to represent and warrant to the Foundation that he/she is the Person lawfully entitled to receive such Prize and such representation and warranty shall survive the awarding of the Prize.

  4. Prior to payout of any Prize, Winners may be required to show evidence that they are eligible to participate in the Lottery, that they are not Ineligible Persons and that they are were authorized to use the credit card used by the Player to pay for the Winning Ticket.

  5. Except for money Prizes, the Foundation may, at its sole discretion, substitute for any Prize:
    • a cash equivalent to the Foundation’s cost of such Prize; or

    • a Prize of equivalent cost to the Foundation.

  6. No representation or warranty for fitness or serviceability of any merchandise or service that constitutes a Prize is given by the Foundation and there will be no implied warranties of fitness or serviceability.

  7. Winners may withdraw their winnings from their Winnings Account by submitting the necessary information required through the “Withdrawal” screen on the Foundation's applicable website. Withdrawal of winnings less than EUR 100 will be paid to the Player in cash. Winnings equal to or more than EUR 100 will be paid by cheque or bank transfer, depending on the Player's country of residence. The Foundation will mail cash/cheques to the Player unless the Parties agree in writing to alternate delivery arrangements. All deliveries will be made to the address submitted by the Player to the Foundation through the Foundation's website. A Player whose withdrawals total an amount equal to or greater than EUR 500 and/or has used one or more credit cards on his Deposit Account, must complete a KYC procedure prior to delivery of the Player's winnings. The KYC procedure requires that a Player send a photocopy of his/her passport or drivers license as proof of identity and to identify that he/she was over 18 years of age when he/she purchased the Ticket. The Player will also be required to send a front and back credit card photocopy to ensure that the credit card(s) used was in fact issued in the name of the Player. Lastly, the Player will be required to mail a copy of a recent credit card(s) statement to validate his/her address; however, a Player will be entitled to censor any sensitive information he/she does not wish the Foundation to view, including names, merchants, totals and payments, etc.

  8. The Names, a photograph and country of residence of all Winners may be publicized by the Foundation, and the Player, as a condition to receiving a Prize, agrees to be photographed. Winning Player(s) may be required to sign additional consents for use of their name and likeness prior to receiving their Prize.

  9. Players are responsible for withdrawing or otherwise using funds that are held in the Player's Winnings Account. Except as otherwise contemplated herein, the Foundation shall not be responsible for making Players aware that they have any winnings in their Winnings Account.

  10. Dormant Accounts which have an account balance will be levied a yearly administrative fee of EUR 10.00 commencing from the date the account becomes dormant. If an account balance is under EUR 10.00, only the amount in the account will be deducted. When an account reaches zero balance, no further fees will be applied. If after a period of two years, the Dormant Account remains dormant and has a balance and the Player has not contacted the Foundation and provided any contrary instructions, any funds remaining in the Dormant Account shall be remitted to ILLF, and the Player shall forfeit any right to any funds in such Dormant Account. Free tickets which have not been used for a period of 2 years will expire on 31 August 2010.

  11. The Charity Allocation Committee of the Foundation will have sole discretion in selecting appropriate Charities for allocation or gifting of any funds available for remittance to Charities by the Foundation.
  1. The Foundation will not be liable for any loss of whatever nature arising from the cancellation of any Draw, including the loss, for whatever reason, of the chance to participate in a Draw. In particular, but without prejudice to the generality of the foregoing, the Foundation will not be liable to any person:
    • in the event of force majeure;

    • for the failure of, or damage or destruction to the Foundation’s central computer system or records, or any part thereof;

    • for delays, losses, errors or omissions resulting from failure of any telecommunications or other data transmission system; and

    • for any delay resulting in non-receipt of any entry for a particular Draw.

  2. In all other cases, whether the liability is contractual or in tort, including without limitation negligence on part of the Foundation or its employees, the liability of the Foundation is limited, if the claim is based on a valid Winning Ticket, to the cost to the Foundation of the Prize in respect of such Ticket, or otherwise, to the amount paid for the Ticket.

  3. Notwithstanding anything else in this Agreement, the Foundation will not be liable for any loss as a result of an act of God, an outbreak of hostilities, riot, civil disturbance, acts of terrorism, the act of any government or authority (including refusal or revocation of any license or consent), fire, explosion, flood, theft, malicious damage, strike, lock-out, or industrial action of any kind.

  4. The Foundation will not be liable for damages which may be caused by the interception or misuse of any Player's credit card details on the Internet.
  1. These Rules and Regulations apply to all Lotteries and all Tickets issued for any Lotteries conducted and managed by the Foundation. The Rules and Regulations, the conditions and explanations appearing on the Tickets and such other conditions as are established by the Foundation, including without restricting the generality of the foregoing, the conditions appearing on the Foundation's website and price structure statements constitute the contractual rights and obligations with respect to Lotteries conducted and managed by the Foundation. In the event of any discrepancy or inconsistency between these Rules and Regulations and the conditions and explanations appearing on a Ticket or the Foundation website, the website of any third party marketing the Lotteries, these Rules and Regulations shall prevail.

  2. If there is a dispute regarding an entry or eligibility for a Prize or claim, the decision of the Foundation will be final and binding.

  3. The relationship between the Parties as well as this Agreement is governed by and construed in accordance with the laws of the Principality of Liechtenstein whose courts shall be the applicable courts of jurisdiction.

  4. The Foundation reserves the right to amend these Rules and Regulations from time to time and vary any of them without prior notice. Current Rules and Regulations will be posted on the Foundation's website and such posting will be deemed notice to the Player. The Player agrees to periodically review the Rules and Regulations.

  5. Where the context is required in these Rules and Regulations, the neuter gender shall include the feminine or masculine gender, or vice versa, and singular shall include the plural and vice versa.

  6. If there is a discrepancy between the English language version of these Rules and Regulations and any other language version the English language version shall be deemed to be correct.

  7. In the event that any of these provisions or the conditions and explanations appearing on a Ticket or the Foundation's website, or such other conditions as are established by the Foundation are determined by a court of competent jurisdiction to be void or unenforceable, such determination shall solely affect such provision, and shall not in itself, render void or unenforceable the remaining provisions thereof.

  8. The Foundation, all Lotteries operated by the Foundation and all operations of the Foundation are carried out with the authorization of the Government of Liechtenstein. The Players participating in the Lottery may be subject to laws of other jurisdictions and it is the Player's responsibility to ensure that they are authorized to participate in the Foundation's Lottery. The Foundation will not be responsible for any losses, taxes, or other costs associated with the Player's participation in a Lottery imposed by any government or other authority. The Foundation does not accept responsibility for any third party claims against the Players.

  9. The personal details of the Players will be collected, used and retained in accordance with the Foundation's privacy policy.

  1. 60% of the purchase of a single Share or Ticket Number for a Draw in the Equinox Lottery game is payable on account of the Ticket price, with the remaining 40% paid as a Fee to third party marketing partners engaged by the Foundation. Of the portion paid for the Ticket price, 83% of these monies are contributed to the Prize pool.

    If a single Share or Ticket Number could win more than one individual Prize in a Draw, only the single highest individual Prize will be paid for all Prize categories.

Euro World Lotto Prize Money Allocation

  1. 66.7% of the purchase price for a Draw in the Euro World Lotto game is payable on account of the Ticket price, with the remaining 33.3% paid as a Fee to third party marketing partners engaged by the Foundation. Of the portion paid for the Ticket price, 90% of these monies are contributed to the Prize Pool. The distribution of the portion of the Ticket allocated to the Prize Pool is as follows:

    • 2% of the Prize Pool is used to fund winners for a 6 Number match, plus bonus ball;

    • 8% of the Prize Pool is used to fund winners for a 6 Number match;

    • 10% of the Prize Pool is used to fund winners for promotional incentive Prizes;

    • on average 2% of the Prize Pool is used to fund winners for a 5 Number match, plus bonus ball;

    • on average 4% of the Prize Pool is used to fund winners for a 5 Number match;

    • on average 7% of the Prize Pool is used to fund winners for a 4 Number match;

    • on average 30% of the Prize Pool is used to fund winners for a 3 Number match; and

    • on average 37% of the Prize Pool is used to fund winners for a 2 Number match.

  2. 5+ bonus and 5 ball Prizes are calculated as a pro-rata share of the remainder of the Prize Pool after the 6+ Bonus Ball, 6, promotional, 4, 3 and 2 ball Prizes have been paid. In the unlikely event that 2 ball Prizes exceed 83% of the Stakes placed, the Foundation will pay exactly 37% of total Stakes split amongst 2-ball winners instead of a EUR 5 prize. In the unlikely event that 3 ball prizes exceed 66% of the Stakes placed, the Foundation will pay 30% of total Stakes split amongst 3-ball winners instead of a EUR 30 prize. In the unlikely event that 4 ball prizes exceed 15% of the Stakes placed, the Foundation will pay 7% of total Stakes split amongst 4-ball winners instead of a EUR 120 prize. If a single Stake could win more than one individual Prize in a Draw, only the single highest individual Prize will be paid for all prize categories.

  3. The following prizes are insured through Arthur J. Gallagher (UK) Limited, a Lloyd's broker:

    • 6 + Bonus number match minimum is EUR 20,000,000.00 (paid as an annuity).

      The actual prize above this minimum amount is dependent on ticket sales and insurance costs.

      Players may opt to receive a lump sum instead of an annuity with regard to the above prize. The lump sum for a 6 + Bonus number match is a minimum of EUR 10,000,000.00. The actual prize above this minimum amount is dependent on ticket sales and insurance costs. EUR 180,000 will be deducted from the above prize for insurance costs. This sum will not be requested from the player, it will be deducted from the prize given to them.

    • 6 number match EUR 2,000,000.00 (paid as an annuity).

      Players may opt to receive a lump sum instead of an annuity with regard to the above prize. The lump sum for a 6 number match is EUR 1,000,000.00.

    In the event of more than one entry winning an insured prize, only the lump sum payment will be made, split equally amongst the winning entries.

    Entries into Euro World Lotto have a mathematical possibility of winning the 6 number plus Bonus Ball match prize of 1 (one) in 601,304,088. Entries have a mathematical possibility of winning the 6 number match insured prize of 1 (one) in 14,316,764.

Little Big One Prize Money Allocation

  1. 50% of the purchase price for a Draw in the Little Big One game is payable on account of the Ticket price, with the remaining 50% paid as a Fee to third party marketing partners engaged by the Foundation. Of the portion paid for the Ticket price, 80% of these monies are contributed to the Prize Pool. The distribution of the portion of the Ticket allocated to the Prize Pool is as follows:

    • 27.79% of the Prize Pool is used to fund winners for a 5 Number match;

    • 49.95% of the Prize Pool is used to fund winners for a 3 Number match;

    • 20.98% of the Prize Pool is used to fund winners for a 0 Number match; and

    • 1.28% of the Prize Pool is used to fund winners for promotional incentive Prizes.

  2. If a single Stake could win more than one individual Prize in a Draw, only the single highest individual Prize will be paid for all Prize categories.

  3. Entries into Little Big One game have a mathematical possibility of winning the 5 number match prize of 1 (one) in 3,003.
